  • Nominees Announced for Fifth District Court Vacancy

    (SALT LAKE CITY, Utah) - The Fifth District Judicial Nominating Commission has selected nominees for a vacancy on the district court. The vacancy results from the retirement of Judge James L. Shumate effective March 31, 2014. The Fifth Judicial District includes Beaver, Iron and Washington counties.

    The nominees for the vacancy are: Keith C. Barnes, Owner, Barnes Law Offices; Paul E. Dame, Judge, Washington County Justice Court; Nathan K. Fisher, Partner, Fisher & Hunter; Scott Garrett, County Attorney, Iron County Attorney’s Office; and Michael F. Leavitt, Shareholder, Durham Jones & Pinegar.

    Written comments can be submitted to Fifth District Judicial Nominating Commission Chair Jon Pike at Commission on Criminal and Juvenile Justice, P.O. Box 142330, Salt Lake City, UT 84114-2330 or judicialvacancies@utah.gov. The deadline for written comments is 5 p.m. on January 20, 2014. The Nominating Commission may request further information or conduct an investigation of the nominees after reviewing public comments. After the public comment period, the names will be sent to Governor Gary R. Herbert, who will have 30 days to make an appointment. Governor Herbert’s appointee is subject to confirmation by the Utah Senate.

    The fact that the malevolent Scott Garrett is up for a judgeship instead of facing criminal charges for corruption is horrifying. Just another reminder of why my family and I fled Utah.
